Comment déclarer mes revenus issus de la musique ?

Nous pouvons penser à pas mal de statuts, d’auto-entrepreneur à star du taupe 50, salarié d’une association ou d’une entreprise d’édition…

Quelle situation ?

Si vos sources de revenus sont composées de :

  1. Royalties (youtube, spotify, etc.), droits d’auteur, et donations
  2. Ventes de licence avec et sans intermédiaire (pour des projets musicaux, des publicités par exemple…)
  3. Concerts : même s’ils sont rares
  4. Ventes de musique (CD et numérique) et de partitions (Papier et numérique)

Des solutions !

Pour tout ce qui relève des royalties et droits d’auteurs, ce sont les BNC (bénéfices non commerciaux) : https://www.service-public.fr/professionnels-entreprises/vosdroits/F31984
Vous devrez déclarer ces revenus dans cette case. Attention toutefois, il existe des plafonds de revenus au delà desquels vous paierez plus d’impôts.
Pour les ventes de produits et services, souvent les statuts diffèrent. Parfois c’est une association des amis de l’artiste qui gère cela pour un auteur, parfois ce sont des statut d’auto-entrepreneur, ou d’indépendant.

À savoir, ce n’est pas spécifique aux artistes libres, bien entendu, mais cela répond, je pense, à la plupart des questions. En fait, tout dépend du plafond que vous allez dépasser (ou pas) sur ces revenus.

Licence creative commons Sampling Plus 1.0 – TEXTE LÉGAL

Vous vous souvenez de ces articles visant à sauvegarder les textes légaux des licences utilisées et proposées sur Dogmazic ? En voici un nouveau 😉

Dans la lignée des licences Creative Commons peu connues, voici la Creative Commons Sampling Plus 1.0.
C’est un exemple intéressant de la souplesse que permettent les licences libres:

En résumé, vous êtes libre d’échantillonner (sampler), faire des mash-ups ou transformer l’œuvre d’une autre manière créative pour des buts commerciaux ou non-commerciaux.
MAIS de la performer, d’afficher et distribuer des copies de l’œuvre entière pour des buts non-commerciaux seulement.

Le tout sous les conditions suivantes:

  • Vous n’avez pas le droit d’utiliser cette œuvre à des fins publicitaires ou de promotion autres que celles destinées à l’œuvre que vous créez à partir d’elle.
  • Vous devez indiquer l’auteur de l’œuvre ou le titulaire des droits (mais pas d’une manière qui suggérerait qu’ils vous approuvent, vous ou votre utilisation de l’œuvre)
  • Et laisser clairs et explicites les termes de la licence pour toute redistribution (par exemple via un lien vers la page Sampling Plus sur le site Creative Commons).

Par contre, elle n’est plus maintenue par Creative Commons depuis le 09/12/11 (qui en déconseille l’utilisation) pour la raison suivante: elle n’est compatible avec aucune autre licence Creative Commons.

Note: ne pas confondre cette licence avec la CC Sampling, et la CC sampling plus Non Commercial, sur lesquelles nous reviendrons plus tard 🙂
