Dans la lignée des licences Creative Commons peu connues, voici la Creative Commons Sampling Plus 1.0.
C’est un exemple intéressant de la souplesse que permettent les licences libres:

En résumé, vous êtes libre d’échantillonner (sampler), faire des mash-ups ou transformer l’œuvre d’une autre manière créative pour des buts commerciaux ou non-commerciaux.
MAIS de la performer, d’afficher et distribuer des copies de l’œuvre entière pour des buts non-commerciaux seulement.

Le tout sous les conditions suivantes:

  • Vous n’avez pas le droit d’utiliser cette œuvre à des fins publicitaires ou de promotion autres que celles destinées à l’œuvre que vous créez à partir d’elle.
  • Vous devez indiquer l’auteur de l’œuvre ou le titulaire des droits (mais pas d’une manière qui suggérerait qu’ils vous approuvent, vous ou votre utilisation de l’œuvre)
  • Et laisser clairs et explicites les termes de la licence pour toute redistribution (par exemple via un lien vers la page Sampling Plus sur le site Creative Commons).

Par contre, elle n’est plus maintenue par Creative Commons depuis le 09/12/11 (qui en déconseille l’utilisation) pour la raison suivante: elle n’est compatible avec aucune autre licence Creative Commons.

Licence Developing Nations 2.0 – texte légal

Une des licence proposée (ou plutôt ayant été proposée) sur Dogmazic ! C’est une licence initialement de 2004 dont le texte légal peut être sauvegardé ici. J’ai nommé, la licence: Developing Nations 2.0

Comme écrit plus haut, la licence Developing Nations 2.0 a été proposée sur Dogmazic, mais désormais elle est déconseillée par Creative Commons – qui recommande de ne pas l’appliquer aux oeuvres. Or je vous propose ici quelques traductions en français, d’articles postés en 2004 et 2007 sur le blog de Creative Commons, pour comprendre les idées véhiculées par cette licence.


    Aujourd’hui, Creative Commons lance une nouvelle licence, appelée Developing Nations. Le résumé est simple: c’est une licence attribution-seulement qui s’applique au sein des pays en voie de développement. Son code légal définit un pays en voie de développement comme « toute nation qui n’est pas classifiée comme une ‘high-income economy’ (NDLT: pays à revenus élevés) par la Banque Mondiale. » ce qui, suivant le site de la Banque Mondiale, signifie qu’elle ne s’applique pas dans cette liste de pays.
    La licence peut être utilisée de plusieurs manières différentes. Elle peut être combinée avec une oeuvre actuellement sous une licence plus restrictive: vos photographies peuvent être protégées d’utilisation commerciale aux États-Unis, mais en y combinant une licence Developing Nations, les mêmes photos pourront être utilisées commercialement, par exemple, au Brésil. Vous pourriez aussi être un musicien ou un photographe qui veut maintenir un copyright complet en Amérique du Nord et en Europe de l’Ouest, mais encourager l’usage de ses oeuvres dans des pays d’Asie du Sud-Est.

    Ajourd’hui nous retirons deux licences Creative Commons – la licence Developing Nations, ainsi que une des trois licences Sampling que nous proposons. Les raisons de ces retraits sont à la fois pratique et de principes.

La raison pratique est un simple manque d’intérêt: depuis le début, Creative Commons a promis de garder notre famille de licences aussi simple que possible. 8. Miscellaneous

Statement of Purpose
