Preamble

The licenses for most musical works are designed to take away your freedom to share the music. I. PREAMBLE

Principles

Digital technology and the Internet can empower artists to reach a worldwide audience and to build upon each other’s ideas and imagination with extremely low production and distribution costs. Many software developers, through both the open source software initiative and the free software movement, have long taken advantage of these facts to create a vibrant community of shared software that benefits creators and the public.

EFF’s Open Audio License provides a legal tool that borrows from both movements providing freedom and openness to use music and other expressive works in new ways. It allows artists to grant the public permission to copy, distribute, adapt, and publicly perform their works royalty-free as long as credit is given to the creator as the Original Author.

As in the software communities, this license is intended to help foster a community of creators and performers who are free to share and build on each others’ work. This license is designed to provide artists with a mechanism to promote their creative talents and identity to millions of people through releasing certain recordings to the public. It is also designed to serve as a tool to allow musicians to experiment with new business models that do not depend solely on a payment of fee-per-copy. Changing times require artists be creative in devising new business models for assuring payment and adequate compensation for their important contributions to society.

Nous allons aborder ici une question essentielle, la citation d’une œuvre dans une autre !

Que dit la loi ?

L’auteur jouit du droit au respect de son nom, de sa qualité et de son œuvre.
Ce droit est attaché à sa personne.
Il est perpétuel, inaliénable et imprescriptible.
Il est transmissible à cause de mort aux héritiers de l’auteur.
L’exercice peut être conféré à un tiers en vertu de dispositions testamentaires.

Article L-121-1 du Code de la Propriété Intellectuelle

La loi défini un principe, celui du respect du nom de l’auteur et du lien avec son œuvre. Pour beaucoup, dans la pratique, il s’agit d’obligatoirement citer le nom de l’auteur original. Or, la loi ne défini pas la pratique, mais un principe. Il n’est donc pas obligatoire de citer un auteur, mais bien de veiller à ce que le respect du nom de l’auteur soit effectif.

Quelques exemples

La Statue de la Liberté

Vous pouvez reprendre la Statue de la Liberté dans beaucoup de publications, l’œuvre étant dans le domaine public, vous n’aurez ni autorisation à demander, ni de sommes à payer pour exploiter l’image de la Statue de la Liberté sur une couverture d’un album. Vous n’aurez même pas à citer sur votre œuvre les auteurs de la Statue de la Liberté… qui sont ? (je vous laisse chercher).

La Marseillaise

Même chose, hein, si vous chantez cet air connu de tous dans un stade, vous n’aurez pas à citer les noms de l’auteur et du compositeur…

Pourquoi ?

Parce que ce sont des œuvres connues de toutes et de tous et que les liens entre les auteurs et leurs œuvres sont déjà mentionnés un peu partout. Le respect du nom de l’auteur est donc de fait déjà établi, nous parlerons volontiers de « notoriété publique ».

Quelques précautions

Si vous empruntez une œuvre (sous Copyright, déposée à la Sacem ou sans mention de licence) à un autre, il vous faut son autorisation.

Si l’œuvre est en licence libre ou ouverte (comme sur Dogmazic), ou si l’œuvre est dans le domaine public (par exemple : http://aventdudomainepublic.org/ ), vous avez la possibilité de citer l’œuvre de l’autre, travailler sur un remix (si la licence vous le permet dans le cadres des licences ouvertes comme les Creative Commons)…

Dans tous les cas, vous devez « respecter le nom de l’auteur » (selon la loi). Très souvent, cela passe par une citation, cela peut aussi passer par un lien vers le site internet de l’auteur, une capture d’écran sur votre site, une citation directe dans votre œuvre, dans un générique d’un clip… La forme importe peu, du moment que votre intention est de « respecter le nom de l’auteur » ! Et si vraiment il y a un doute, ce sera à un juge de décider si votre intention est de nuire à l’auteur ou à sa moralité.

La Radio fait son « grand » retour sur Dogmazic, avec quelques petits soucis côté serveur, mais @luciolebrillante s’y attelle avec ses petites mains. La page d’accueil aussi, a subi des améliorations. En comptant en fournir d’autres. Quelques lenteurs sont perceptibles dû au codage de la page d’accueil, et de celle d’Ampache (le logiciel multimédia, qui permet la lecture et le stockage de l’archive).

Licence Musique Libre – et son texte légal

Bonjour !

Voici à nouveau un article sur les licences libres utilisées aujourd’hui (ou dans le passé) sur l’archive Dogmazic. Si vous avez déjà vu un de ces articles, alors vous savez que leur but est en premier lieu de sauvegarder ces licences. En deuxième lieu, de les présenter (voire exhumer 😉 ) au grand jour !

Oui, « sauvegarder ». Les artistes qui publient leur musique sur Dogmazic peuvent choisir entre de nombreuses licences, et il nous a semblé judicieux de s’en assurer une copie sur nos propres serveurs, afin de ne pas dépendre des aléas du net. C’est important de ne pas compter éternellement sur des supports externes…

…et la Licence Musique Libre qui est l’objet de cet article en est un très bon exemple 🙂 nous savions qu’elle existait, puisque nous en trouvions trace dans nos tableaux résumant les licences utilisées sur Dogmazic (comme celui-ci), mais ??? ensuite ??? elle était devenue complètement introuvable…
Votre humble serviteur s’est pourtant démené dans le web référencé ET le web non-référencé, en utilisant des sites comme archive.org mais aussi des équivalents du monde entier (y compris un site d’archivage du net chinois) ! Que nenni ! Liens morts, liens morts, partout des liens morts ! Une hécatombe !
C’est seulement en s’y mettant à plusieurs, avec la précieuse aide (et mémoire) de Aisyk notamment que nous avons pu ENFIN retrouver cette licence. Et ce n’est pas étonnant que ç’ait été difficile : elle n’était initialement hébergée (semble-t-il) qu’en un unique point du net, qu’il fallait connaître.
Mais j’arrête là cette saga, c’est un article sur la licence, pas sur son hébergement. Vous avez compris : nous avons été d’autant plus stimulés pour faire une sauvegarde de notre côté.

Alors, cette licence ?

La Licence Musique Libre est la licence du groupe Miss Helium, un groupe punk engagé qui jouait principalement dans les années 2000. Elle date de 2004 en version 1.0. Elle confère la liberté de copier, diffuser, représenter, échantillonner, mixer et incorporer tout ou partie de l’œuvre. Ce n’est pourtant pas une CC-BY ! Il y a une clause spéciale :

« L’incorporation de l’œuvre avec un support visuel (film, reportages, spectacles, …) est soumise à l’autorisation des auteurs. »

Donc voilà, une licence de libre diffusion à l’exception des supports visuels (on peut penser à la publicité) qui ne sont pas exclus, mais qui exigent l’autorisation des auteurs.

1. Objet

Cette licence a pour objet de définir les conditions selon lesquelles vous pouvez jouir librement de cette œuvre.

2. Étendue de la jouissance

Cette œuvre est soumise au droit d’auteur, et l’auteur par cette licence vous indique quelles sont vos libertés pour la copier, la diffuser, la modifier et l’incorporer. Toute utilisation sortant du cadre de cette licence est soumise à l’autorisation des auteurs.

– par haut-parleur dans n’importe quel lieu public ou privé, commercial ou non.

2.3 La liberté de modifier, d’échantillonner, de mixer

Vous avez la liberté, dans le respect des conditions prévues à l’article 2.1 et 2.2 en cas de diffusion (ou représentation) de la copie modifiée,
– de modifier les copies des originaux, qui peuvent être partielles ou non.
– d’échantillonner (sampling) une partie de l’œuvre
– de mixer cette œuvre, en totalité ou partie, avec n’importe quelle musique ou instrument de musique.

3. L’incorporation de l’œuvre

Vous avez la liberté d’incorporer cette œuvre dans votre propre œuvre, dans le respect des conditions prévues à l’article 2.1, 2.2, et 2.3 en cas de diffusion (ou représentation) de la copie modifiée. L’incorporation de l’œuvre avec un support visuel (film, reportages, spectacles, …) est soumise à l’autorisation des auteurs.

4. La durée de la licence

Cette licence prend effet dès votre acceptation de ses dispositions. Le fait de copier, de diffuser ou de modifier l’œuvre constitue une acceptation tacite.
Cette licence a pour durée la durée des droits d’auteurs attachés à l’œuvre. Si vous ne respectez pas les termes de cette licence, vous perdez automatiquement les droits qu’elle vous confère.
Si le régime juridique auquel vous êtes soumis ne vous permet pas de respecter les termes de cette licence, vous ne pouvez pas vous prévaloir des libertés qu’elle vous confère.

5. Les différentes versions de la licence

Cette licence pourra être modifiée régulièrement, en vue de son amélioration, par ses auteurs, sous la forme de nouvelles versions datées et numérotées. La version valable est celle en vigueur (sur www.diogene.ch) à la date ou vous copiez, diffusez ou modifiez cette œuvre.

6. La loi applicable au contrat

Cette licence est soumise au droit français.

Comment déclarer mes revenus issus de la musique ?

Nous pouvons penser à pas mal de statuts, d’auto-entrepreneur à star du taupe 50, salarié d’une association ou d’une entreprise d’édition…

Quelle situation ?

Si vos sources de revenus sont composées de :

  1. Royalties (youtube, spotify, etc.), droits d’auteur, et donations
  2. Ventes de licence avec et sans intermédiaire (pour des projets musicaux, des publicités par exemple…)
  3. Concerts : même s’ils sont rares
  4. Ventes de musique (CD et numérique) et de partitions (Papier et numérique)

Des solutions !

Pour tout ce qui relève des royalties et droits d’auteurs, ce sont les BNC (bénéfices non commerciaux) : https://www.service-public.fr/professionnels-entreprises/vosdroits/F31984
Vous devrez déclarer ces revenus dans cette case. Attention toutefois, il existe des plafonds de revenus au delà desquels vous paierez plus d’impôts.
Pour les ventes de produits et services, souvent les statuts diffèrent. Parfois c’est une association des amis de l’artiste qui gère cela pour un auteur, parfois ce sont des statut d’auto-entrepreneur, ou d’indépendant.

Vous vous souvenez de ces articles visant à sauvegarder les textes légaux des licences utilisées et proposées sur Dogmazic ? En voici un nouveau 😉

Dans la lignée des licences Creative Commons peu connues, voici la Creative Commons Sampling Plus 1.0.
C’est un exemple intéressant de la souplesse que permettent les licences libres:

En résumé, vous êtes libre d’échantillonner (sampler), faire des mash-ups ou transformer l’œuvre d’une autre manière créative pour des buts commerciaux ou non-commerciaux.
MAIS de la performer, d’afficher et distribuer des copies de l’œuvre entière pour des buts non-commerciaux seulement.

Le tout sous les conditions suivantes:

  • Vous n’avez pas le droit d’utiliser cette œuvre à des fins publicitaires ou de promotion autres que celles destinées à l’œuvre que vous créez à partir d’elle.
  • Vous devez indiquer l’auteur de l’œuvre ou le titulaire des droits (mais pas d’une manière qui suggérerait qu’ils vous approuvent, vous ou votre utilisation de l’œuvre)
  • Et laisser clairs et explicites les termes de la licence pour toute redistribution (par exemple via un lien vers la page Sampling Plus sur le site Creative Commons).

Licence Developing Nations 2.0 – texte légal

Une des licence proposée (ou plutôt ayant été proposée) sur Dogmazic ! C’est une licence initialement de 2004 dont le texte légal peut être sauvegardé ici. J’ai nommé, la licence: Developing Nations 2.0

Comme écrit plus haut, la licence Developing Nations 2.0 a été proposée sur Dogmazic, mais désormais elle est déconseillée par Creative Commons – qui recommande de ne pas l’appliquer aux oeuvres. Or je vous propose ici quelques traductions en français, d’articles postés en 2004 et 2007 sur le blog de Creative Commons, pour comprendre les idées véhiculées par cette licence.


    Aujourd’hui, Creative Commons lance une nouvelle licence, appelée Developing Nations. Le résumé est simple: c’est une licence attribution-seulement qui s’applique au sein des pays en voie de développement. Son code légal définit un pays en voie de développement comme « toute nation qui n’est pas classifiée comme une ‘high-income economy’ (NDLT: pays à revenus élevés) par la Banque Mondiale. » ce qui, suivant le site de la Banque Mondiale, signifie qu’elle ne s’applique pas dans cette liste de pays.
    La licence peut être utilisée de plusieurs manières différentes. Elle peut être combinée avec une oeuvre actuellement sous une licence plus restrictive: vos photographies peuvent être protégées d’utilisation commerciale aux États-Unis, mais en y combinant une licence Developing Nations, les mêmes photos pourront être utilisées commercialement, par exemple, au Brésil. Vous pourriez aussi être un musicien ou un photographe qui veut maintenir un copyright complet en Amérique du Nord et en Europe de l’Ouest, mais encourager l’usage de ses oeuvres dans des pays d’Asie du Sud-Est.

    Ajourd’hui nous retirons deux licences Creative Commons – la licence Developing Nations, ainsi que une des trois licences Sampling que nous proposons. Les raisons de ces retraits sont à la fois pratique et de principes.

La raison pratique est un simple manque d’intérêt: depuis le début, Creative Commons a promis de garder notre famille de licences aussi simple que possible. Statement of Purpose
